Acceptance of Terms
OtakuIsland ("we", "us", "our", or "the Company") operates the website otakuisland.in and all associated subdomains, applications, and services. These Terms of Service ("Terms") govern your access to and use of our platform.
These Terms constitute a legally binding agreement between you ("User", "Customer", or "you") and OtakuIsland. Your continued use of the website after any update to these Terms constitutes acceptance of the revised Terms. We reserve the right to modify these Terms at any time without prior individual notice.
These Terms are to be read in conjunction with our Privacy Policy, Refund Policy, and Shipping Policy, all of which are incorporated herein by reference.
Eligibility
To purchase from OtakuIsland, you must:
- Be at least 18 years of age, or be at least 13 years of age with verifiable parental/guardian consent and supervision
- Be a resident of India or have a valid Indian shipping address
- Provide accurate, current, and complete personal information
- Not be barred from using our services under any applicable law
By using the website, you represent and warrant that you meet all of the above eligibility requirements. If you are placing an order on behalf of another person, you represent that you have authority to bind that person to these Terms.
Products & Listings
3.1 Product Descriptions. We make every effort to display our products as accurately as possible. However, we do not warrant that product descriptions, photographs, dimensions, colours, or other content on the website are completely accurate, current, or error-free. Actual product colours may vary slightly from what appears on your screen due to monitor settings and display calibration.
3.2 Product Availability. All products are subject to availability. We reserve the right, without liability, to limit the quantities of any product, discontinue any product, or refuse service to any customer at any time for any reason.
3.3 Scale & Dimensions. All figures and collectibles are sold as decorative/collector items. Dimensions and scale listed are approximate. Minor variations of up to ±5% in stated measurements are considered within acceptable tolerance and do not constitute a defect or grounds for return.
3.4 Fan-Made & Inspired Products. Some items in our catalogue are fan-made, artist-made, or fan-inspired products that are not officially licensed by the original IP holders. These are clearly intended as homage and collector items. We make no representation that such products are officially endorsed or licensed unless explicitly stated on the product page.
3.5 Right to Withdraw. We reserve the absolute right to withdraw any product from sale at any time and to refuse orders for products that are withdrawn, even after order placement. In such cases, a full refund will be issued within 7 business days.
Pricing & Payment
4.1 Pricing. All prices on OtakuIsland are listed in Indian Rupees (INR) and include applicable GST unless stated otherwise. We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time of order completion.
4.2 Pricing Errors. In the event of a pricing error (including technical glitches, typographical errors, or system errors), we reserve the right to:
- Cancel the order and issue a full refund
- Contact you to offer the product at the correct price
- Refuse to honor the incorrect price
Your acceptance of these Terms acknowledges that you understand pricing errors may occur and agree not to hold us liable for such errors.
4.3 Payment Methods. We accept the following payment methods:

4.4 Payment Security. All online payments are processed through Razorpay, a PCI DSS compliant payment gateway. OtakuIsland does not store your card or banking credentials on our servers.
4.5 Failed Payments. If your payment fails after your order is placed, the order will be automatically cancelled. Any amount debited will be refunded to your original payment method within 5–7 business days, subject to your bank's processing time. We are not responsible for delays caused by your bank or payment provider.
Orders & Confirmation
5.1 Order Placement. An order constitutes an offer to purchase products from us. Placing an order does not guarantee that the order will be accepted. A contract between you and us is only formed upon dispatch of your order and issuance of a shipping confirmation.
5.2 Order Confirmation. Upon successful order placement, you will receive an email/SMS confirmation with your order ID. This is an acknowledgement of receipt only — not an acceptance of the order.
5.3 Order Cancellation by Us. We reserve the right to cancel any order at our sole discretion, including but not limited to situations where:
- The product is out of stock or discontinued after order placement
- Pricing or promotional errors exist on the listing
- We are unable to verify the delivery address or customer details
- We suspect fraudulent activity or policy violations
- Payment is not successfully captured
- The order contains unusually large quantities (bulk orders without prior arrangement)
5.4 Order Modification. Once an order is confirmed and dispatched, it cannot be modified. Cancellation requests must be made before the order is dispatched. We will make reasonable efforts to accommodate pre-dispatch cancellations but cannot guarantee success.
5.5 Duplicate Orders. If you accidentally place duplicate orders, contact us immediately at support@otakuisland.in. We cannot guarantee cancellation of a duplicate if it has already been dispatched.
Shipping & Delivery
6.1 Delivery Timeline. Estimated delivery times are 3–7 business days across India. These are estimates only — not guarantees. Delivery timelines may be extended due to:
- Natural disasters, floods, strikes, or force majeure events
- Delays caused by our courier partners
- Inaccessible delivery addresses or gated communities
- Public holidays and peak seasons
- Remote or PIN code-restricted areas
6.2 Shipping Charges. Free shipping is available on orders above ₹999. A flat shipping fee of ₹99 applies to orders below ₹999. Shipping charges are non-refundable once an order is dispatched unless the return is due to our error.
6.3 Delivery Responsibility. Once an order is handed to our logistics partner and a tracking ID is shared with you, OtakuIsland's responsibility for physical delivery passes to the courier. We are not liable for delays, lost parcels, or damages caused by the courier after dispatch. However, we will assist in raising disputes with the courier on your behalf.
6.4 Undelivered Orders. If a delivery attempt fails due to incorrect address, absence of recipient, or refusal at the door, the parcel may be returned to us. In such cases, re-shipping charges will apply and are the customer's responsibility. Orders returned due to customer non-availability will be refunded minus shipping costs.
6.5 Address Accuracy. You are solely responsible for providing a complete and accurate delivery address. OtakuIsland is not liable for lost, delayed, or misdirected shipments due to incorrect address information provided at checkout.
Returns & Refunds
7.1 Return Window. We offer a 7-day return window from the date of delivery for eligible products. Return requests must be initiated within this period. Requests submitted after 7 days will not be accepted under any circumstances.
7.2 Eligible Return Conditions. A return will only be accepted if:
- The product is significantly different from what was described or shown on the product page
- The product arrived physically damaged (structural damage, not cosmetic/packaging damage)
- The product is missing major components listed in the product description
- A wrong product was delivered
7.3 Non-Returnable Conditions. The following are explicitly not eligible for return or refund:
- Change of mind or buyer's remorse after delivery
- Minor colour variation from product photos due to screen calibration
- Minor dimensional variance within the ±5% tolerance stated in Section 3.3
- Products where the original packaging has been opened, used, or damaged by the customer
- Products returned without original packaging, accessories, and tags
- Products damaged by the customer after delivery
- Customized, made-to-order, or personalized products
- Products on clearance, flash sale, or marked "Final Sale"
- Digital products and gift cards
- Products reported after the 7-day return window
7.4 Return Process. To initiate a return:
- Email support@otakuisland.in with your Order ID and reason for return
- Attach clear photographs/video of the issue (mandatory for damage claims)
- Our team will respond within 2 business days with a decision
- If approved, we will arrange a reverse pickup or ask you to self-ship
- Refund will be processed within 7–10 business days of receiving and inspecting the returned item
7.5 Refund Method. Refunds will be issued to the original payment method used. COD orders will be refunded via bank transfer or UPI (you must provide details). We are not responsible for delays caused by your bank's processing time after we initiate the refund.
Cash on Delivery (COD)
8.1 COD Availability. Cash on Delivery is available across most serviceable PIN codes in India. COD availability is subject to change and may not be available for all products, order values, or locations. We reserve the right to withdraw COD as a payment option at our discretion.
8.2 COD Order Responsibility. By placing a COD order, you commit to being available to receive the order and to pay the exact amount due at the time of delivery. Refusing a COD delivery or non-payment at delivery constitutes a breach of these Terms.
8.3 COD Non-Delivery Penalty. If you refuse delivery of a COD order without valid reason after it has been dispatched, OtakuIsland reserves the right to:
- Block future COD purchases from your account or address
- Charge return shipping costs against future orders or seek recovery
- Escalate repeated abuse to appropriate legal authorities
8.4 COD Order Verification. We may call you to verify COD orders before dispatch. If we cannot reach you for verification, we reserve the right to cancel the order. This is done to prevent fraud and protect both parties.
8.5 COD Refunds. Refunds on COD orders are processed via NEFT/IMPS bank transfer or UPI only. We do not send cash refunds. You must provide accurate bank account or UPI details when requesting a refund on a COD order.
Intellectual Property
9.1 OtakuIsland IP. All content on the OtakuIsland website — including but not limited to the logo, brand name, website design, text, photographs, graphics, user interface, and code — is the intellectual property of OtakuIsland and is protected under the Copyright Act, 1957 (India) and applicable trademark laws.
9.2 Prohibited Actions. You may not, without our express written permission:
- Copy, reproduce, or redistribute any content from our website
- Use our branding, logo, or product photographs on any other platform or for commercial purposes
- Create derivative works based on our website design or content
- Scrape our website for data, pricing, or product information
- Use our website content for any AI training, automated data collection, or competitive intelligence
9.3 Third-Party IP. Character names, logos, and imagery related to anime, manga, gaming, and entertainment franchises featured on our website remain the property of their respective IP holders. We respect intellectual property rights and operate in good faith.
9.4 User Content. By submitting reviews, photographs, or other content to OtakuIsland, you grant us a royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, and display such content in connection with our business and marketing activities.
Disclaimer & Limitation of Liability
10.1 As-Is Basis. The OtakuIsland website and its services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
10.2 Collector Items. All figures, statues, and collectibles sold on OtakuIsland are decorative/collector items intended for adult display purposes. They are not toys and are not suitable for children under 14. We are not liable for any injury, damage, or harm arising from misuse of our products.
10.3 Limitation of Liability. To the maximum extent permitted by applicable law, OtakuIsland's total liability to you for any claim arising from or related to these Terms or your use of our services shall not exceed the amount paid by you for the specific order giving rise to the claim. In no event shall we be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or goodwill
- Damages resulting from courier/logistics partner delays or failures
- Damages resulting from force majeure events
- Damages from unauthorized access to your account
10.4 Website Availability. We do not guarantee uninterrupted or error-free operation of the website. We reserve the right to perform maintenance, updates, or modifications that may temporarily make the website unavailable. We are not liable for any loss arising from such unavailability.
Prohibited Use
You agree not to use OtakuIsland's website or services for any of the following:
- Any unlawful, fraudulent, or malicious purpose
- Submitting false, misleading, or defamatory reviews or product information
- Placing orders with fraudulent payment methods or identity
- Purchasing for resale without prior written authorization from OtakuIsland
- Bulk purchasing or stockpiling during sales/promotions using multiple accounts
- Attempting to exploit pricing glitches, promotional codes, or system errors in bad faith
- Using automated bots, scripts, or crawlers to interact with our website
- Reverse engineering, decompiling, or attempting to extract source code from our platform
- Harassing, threatening, or abusing our staff in any manner (physical, verbal, or digital)
- Creating multiple accounts to circumvent bans, restrictions, or COD blocks
Violations may result in immediate account suspension, order cancellation, permanent platform ban, and legal action as appropriate.
Indemnification
You agree to defend, indemnify, and hold harmless OtakuIsland, its owners, employees, affiliates, agents, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your breach of these Terms of Service
- Your violation of any applicable law or regulation
- Your violation of any third party's rights, including intellectual property rights
- Any content you submit to our platform
- Your misuse of our products or services
- Fraudulent or bad-faith actions by you in connection with our platform
Changes to Terms
OtakuIsland reserves the right to update, modify, or replace any part of these Terms at any time. Changes will be effective immediately upon posting on the website with an updated "Last Updated" date. We may — but are not obligated to — notify you of material changes via email or website notice.
Your continued use of the website after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically. If you do not agree with the updated Terms, you must discontinue use of the website immediately.
Governing Law & Dispute Resolution
14.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of India, specifically the statutes applicable in the state of Tamil Nadu, without regard to conflict of law principles.
14.2 Jurisdiction. Any dispute arising out of or in connection with these Terms, including disputes relating to their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts located in Coimbatore, Tamil Nadu, India.
14.3 Dispute Resolution Process. Before initiating legal proceedings, both parties agree to attempt resolution in good faith through the following steps:
- Direct Resolution: Contact our support team at support@otakuisland.in. We will respond within 3 business days.
- Mediation: If direct resolution fails, either party may request mediation through a mutually agreed mediator in Coimbatore.
- Litigation: If mediation fails, the matter shall proceed to competent courts in Coimbatore, Tamil Nadu.
14.4 Consumer Rights. Nothing in these Terms shall be construed to limit or waive your rights under the Consumer Protection Act, 2019 (India) or any other applicable consumer protection legislation in India.
